Terms & Conditions

By using any portion of LagoonSpace Web Solutions service, you are agreeing to this service agreement on this document entirely. LagoonSpace Web Solutions reserves the right to modify this policy at any time, effective immediately upon posting of the modification on the website.

1. Use of services

1. Excessive CPU, Bandwidh or Disk Space Usage has the ability to compromise our shared hosting environment. This is the result of using the system in a manner that encumbers disk space, processors or other system resources beyond the allowances of your specific plan type and to the degree that your usage compromises the hosting accounts of our other customers.
2. Excessive resource usage - cgi scripts or other executable code that consumes an undue amount of CPU time [defined dynamically by LagoonSpace Web Solutions at will] will be reprioritized if possible, or we will ask you to discontinue its use either permanently or the script is altered by yourself or third party to operate in a less resource-hungry manner. Failure to cease operator of the offending executable will be considered as server abuse. LagoonSpace Web Solutions reserves the right to terminate any process which it deems to be using excessive resource usage.
3. Background processes - background process [that is, application or utilities that are started from within an interactive shell login, and set to run permanently in the background on a server] are not to be initiated without prior arrangement with use. We reserve the right to examine all code before it is run on the server. Running of background processes without prior arrangement in and confirmation in writing from LagoonSpace Web Solutions is server abuse.
4. Pornography - LagoonSpace Web Solutions prohibits the storage and transmission (inbound and outbound) of pornography with the exception of softcore erotic art. Written permission must be obtained before any pornographic material is stored and/or transmitted through LagoonSpace Web Solutions servers.
5. Copyright software, Warez, destructive applications, copyright media, proprietary computer information and hacking & cracking sites are strictly prohibited on any portion of our services and network. Customers storing & transmitting (inbound and outbound) files that violate copyright or other federal laws are grounds for instant termination of service.
6. Any incident of server abuse is grounds for immediate and unconditional account termination. Common examples of abusive practices are listed below and LagoonSpace Web Solutions reserves the right of interpretation as to what constitutes abusive practices. In short - if you are unsure that your actions may be perceived as an abuse of service, contact LagoonSpace Web Solutions directly to check with us before proceeding.
7. Email abuse - Unsolicited Commercial Email ['Spam'] is implicitly forbidden. This is considered server abuse and is grounds for immediate termination.
8. Selling for free - LagoonSpace Web Solutions prohibits any portion of its services to be resold without charge. This includes but not limited to: entire hosting accounts, email services, scripts, FTP accounts, MySQL databases, applications, licenses, webspace and bandwidth (this includes image hosting and file/data hosting services, either free or subscription/fee based).
9. Proxy websites and such are prohibited.
10 LagoonSpace Web Solutions will not tolerate misuse of space, the space allocated is for website only. It can not be used for storing files or softwares not linked to website.
11. We do not allow hosting of mp3 files and video files.
12. File hosting sites or sites designed primarly for download contents are not allowed in our webspace.
13. Bandwidth allocated is only for website hosted on our server, Using bandwidth for other websites by hotlinking is not allowed.
14. Webmail can be used only for temporary storage of emails, we recommend our customer to use pop3 to download emails to their own PC. Storing email in webmail is not allowed.
15. "Unlimited Bandwidth" - LagoonSpace Web Solutions does not gaurantee that any particular website will get Unlimited bandwidth. This always depends on load on server. All users will continue to expirience maximum bandwidth untill the server reaches its threshold limit. Once the server has reached this limit for a particular user/website, its performance will decrease. Threshold limit of server and ultimately user is controlled by LagoonSpace Web Solutions.
16. Database for all shared hosting servers are can accomodate maximum upto 200MB of data, if any website exceeds this limit LaggonSpace doesnot gaurantee seamless performance for that website. Such users should are always adviced to go for VPS in order to minimize server load on shared hosting.
17. If "Resource Utilization Policy" is not followed correctly, LagoonSpace Web Solutions will not gaurantee the performance of any type of shared hosting service.
18. We do not allow hosting of adult sites on our servers.
19. We provide unmanaged VPS services. Once a VPS is purchased we donot involve in its maintenance and monitoring activities. The User/Client is responsible for all issues caused after first 20 days of purchase. We will not install third party applications on the server unless mentioned by the user/client in an email to support@lagoonspace.com. After following this process the user/client will be responsible for any malfunctions of the server caused due installed third party application.
20. For VPS service, User/Client should maintain his/her backup of database and content as we donot provide any backup services(other than "Free Database Backup *").
21. Since all our VPS services are billed monthly, user/client should us(support@lagoonspace.com) for continuation or discontinuation of service. Failing to do so the purchased VPS service might be terminated for non payment of dues. We will inform all users/clients 15 days prior to date of renewal(only for VPS services). If the user/client wishes to continue the service he/she should inform us(support@lagoonspace.com) for extension of service alongwith payment for the same.By default the VPS service will be disabled if we(support@lagoonspace.com) do not recieve any reply within mentioned timelines.
22. Price Match Guarantee - If any user finds a service which has features exactly similar to LagoonSpace Web Solutions or exact similar features + additional features at a lower price than LagoonSpace Web Solutions, then LagoonSpace Web Solutions will match the new price for that user. In order to avail this facility user should first buy the said service and provid legitimate information for comparison. If provided information is found correct and according to our "Price Match" rule than user will be refunded with the remainder. Comparison information should be provided with in 15 days of newly purchased service.

2. Payment and Bills

1. All accounts are set-up on a pre-pay basis only.
2. LagoonSpace Web Solutions will suspend your account if outstanding bills have not been paid in within 5 days. LagoonSpace Web Solutions reserves the right to suspend the account.
3. LagoonSpace Web Solutions reserves the right to impose a re-activation fee for accounts that have been suspended.
4. All payments to LagoonSpace Web Solutions are non refundable. Unless agreed otherwise.
5. All payments made using 2Checkout Payment Gateway are subject to a Currency Conversion Charge. This charge may change with or without notice.
6. Only the "Website Builder Plans" are refundable within 15 days of purchase only.
7. All refunds might be subject to deductions by a fee levied by Payment Gateway Service providers. LagoonSpace Web Solutions has the right to deny any refund request which is greater than 15 days of date of purchase.
8. LagoonSpace Web Solutions reserves the right to close any services with an appropriate notice issued to all its users. This closure of service notice will be issued 7 days(minimum) prior to any closure. Lagoonspace Web Solutions will issue a refund for any service which was renewed 15 days prior to Notice of Closure for applicable service. LagoonSpace Web Solutions will try to provide an alternate solution to the customer for applicable closing service, before services are closed.

3. Backups

1. We strongly encourage all of our customers to do their own backups on their home computers or CD to ensure you have ready access to your data in the event, we should have a hardware failure. Although we regularly take backups of our server and we do not expect anything like this to occur, we want you to be prepared in the event that it does. Please kindly take backups of your all files.
2. Even the best and most complete and redundant backup systems can and do fail for a variety of reasons, despite the best efforts of the Web hosting service. THEREFORE, LAGOONSPACE WEB SOLUTIONS DOES NOT GUARANTEE THE AVAILABILITY, COMPLETENESS OR INTEGRITY OF THESE BACKUPS OR THE DATA THEY CONTAIN. Consequently, you must not rely upon the availability, completenes or integrity of these backups.
3. Customers are responsible for maintaining their own backups on their own personal computers or other computers.
4. LagoonSpace Web Solutions does not provide any sort of compensation for lost, inaccurate, incomplete, or outdated data in the event that LagoonSpace Web Solutions's backups do not function properly, regardless of the reason(s) for any such malfunction, even if the malfunction was due to the fault or negligence of LagoonSpace Web Solutions.
5. LagoonSpace Web Solutions will provide Free backups for Unlimited, Reseller and Email plans for upto 5 days. This free addon is not available for VPS solution, users will have to purchase an addon to backup data on VPS.

4. Resource Usage

User May not do:
• Use 2.0% of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
• Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
• Run any type of web spider on shared servers.
• Run any software that interfaces with an IRC (Internet Relay Chat) network.
• Run any bit torrent application, tracker, or client. Please note that you may link to torrents off server, but may not host or store them.
• Participate in any file-sharing/peer-to-peer activities.
• Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
• Run cron entries with intervals of less than 15 minutes.
• Use daily average system resources (CPU, RAM, MySQL) more than 1% If any site do not follow above resource usage policies, LagoonSpace Web Solutions will have right to suspend the service.
